Unemployment after job loss or reduced hours

A filing and record check after a layoff, firing, quit, or cut in work hours.

The short version

Apply first; EDD decides how the job ended

Apply when a job ends or hours are cut. A quit, firing, 1099 label, or employer objection is not an automatic answer, because EDD reviews the facts. After filing, certify every two weeks, follow the work-search instructions, and report all work and gross wages in the week they were earned.

What changes the answer: A written appeal is generally due within 30 days after EDD mailed the decision or overpayment notice. Keep certifying while the appeal is open, because EDD can only pay weeks that were certified and otherwise eligible.

Unemployment is a week-by-week benefit. Filing starts the claim, but notices, certifications, work searches, and wage reports keep it moving.

How it works

The application opens the claim; each week has its own test

Apply as soon as the job ends or hours are reduced. Give EDD the employer names, work dates, gross wages, last day worked, and the best plain account of why the work stopped. Save the confirmation and every notice.

The claim sets up the wage record and possible weekly amount. It does not decide every later week. For each week, a claimant generally must be unemployed or partly unemployed, able and available to work, looking for work, and ready to accept suitable work.

A quit or firing calls for facts, not a quick label

EDD may send questions or schedule an interview after a quit or firing. Explain what happened in date order. Keep warnings, schedules, messages, medical notes, safety reports, requests for help, and the employer's response when those records fit the separation.

A 1099 or contractor agreement does not close the door. EDD tells a worker who may have been misclassified to apply so the agency can decide eligibility. Give the real work facts, not only the label on the tax form.

Certification keeps the claim alive

EDD normally asks for certification every two weeks. Answer each question for the week it covers. The first eligible certification usually includes a one-week unpaid waiting period, and that waiting week still must meet the rules and be certified.

Read the work-search directions on the award or registration notice. Keep a simple list of job contacts and other allowed search steps. Most people also need to register in CalJOBS and post a resume within the time on the EDD notice.

Report work when it was done, not when the paycheck arrives

Part-time work or reduced hours can still fit unemployment. Report every employer, hours worked, and gross wages before deductions. Put the wages in the actual Sunday-through-Saturday week when the work was done and the wages were earned.

Do this even if the employer has not paid yet. Other pay, including severance, vacation, pension, commissions, residuals, or self-employment income, may use special questions. Read the current EDD directions instead of guessing which week or box to use.

A denial or overpayment notice starts another clock

Read the mailing date, reason, amount, weeks, and appeal address. EDD generally gives 30 days to send a written appeal. A late appeal needs a reason, and the judge decides whether the late reason is good enough to continue.

Keep certifying while the appeal is pending. Save proof of mailing or online delivery and organize the papers by week. An appeal of the EDD decision, an employer dispute, and a request to waive or repay an overpayment can involve different issues.

First moves

    Apply through EDD as soon as the job ends or hours are cut. Do not wait for the employer's view of the claim.

    Gather your Social Security number or work authorization record, identity papers, mailing address, and the names, addresses, dates, and gross wages for employers in the past 18 months.

    Write down the last day worked, why the work ended, any severance or vacation pay, and whether you expect more work from that employer.

    Save the application confirmation and every email, text, and mailed notice. Open EDD mail as soon as it arrives.

    Read the Notice of Unemployment Insurance Award carefully. It shows the wages EDD used and a possible benefit amount; it is not a final promise that every week is eligible.

    Unemployment generally requires you to be fully or partly out of work, out of work through no fault of your own, able and available to work, and looking for work each week.

    A quit or firing does not create an automatic yes or no. EDD may ask for more facts from you and the employer.

    A 1099 or contractor label does not block an application. EDD says a possibly misclassified worker can apply and receive a decision.
